Asylum and Refugee Protection

The Basic Law for the Federal Republic of Germany stipulates that “Persons persecuted on political grounds shall have the right of asylum”. Article 16a (1) is an expression of Germany’s willingness to fulfil its historical and humanitarian obligation to admit refugees. It is the only fundamental right which is applicable only to foreigners. The EU’s obligation to help people in need of protection is anchored in the Charter of Fundamental Rights and in the Treaty on the Functioning of the European Union.
